Terms & Conditions

These Terms and Conditions are an agreement between Ana Solo, Alison Kay and you. By registering for or participating in this retreat, you confirm that you have read, understand and agree to these Terms. Terms may be modified at any time by posting a revised version on the Ana Solo website here: Terms and Conditions. By participating in the retreat, you agree to the latest version of these Terms.

Registration

To register for the retreat, you must complete the online form on this website. You will then receive a confirmation email with payment details. Your booking will only be confirmed once we have received the full fee of $560.

Payment

Full payment is required within 3 days of receiving your confirmation email. If payment is not received within this timeframe, your booking will be cancelled. We are not liable for any direct or indirect damages resulting from such cancellation.

Cancellation by You

If you cancel your booking or are unable to attend the retreat for any reason, the following cancellation fees will apply:

Time before the retreat start dateCancellation Fee (as a percentage of the full payment):
· More than 30 days: 10%
· 30 days or less: 100% (no refund)

Booking transfers:
You may transfer your booking to another person at any time free of charge. Please notify us in writing with the new attendee’s details.

Retreat Programme and Cancellation

The retreat programme is subject to change. We reserve the right to cancel the retreat at any time, or to deny, limit, or cancel a registration (including a confirmed booking) at our sole discretion. We are not responsible for any direct or indirect damages resulting from such cancellation.

If we cancel the retreat or your registration – and you are in compliance with these Terms we will issue a full refund of the retreat fee you have paid.

Code of Conduct

You agree to conduct yourself in a respectful and supportive manner throughout the retreat. Behaviour that negatively impacts the retreat or other participants may result in your removal from the retreat without refund.

Assumption of Risk

You acknowledge and agree that your attendance and participation in the retreat is voluntary. You agree to assume the risks associated with attending and participating in the Retreat to the fullest extent permitted under applicable law. You will advise the organiser of any health and physical limitations or concerns ahead of the Retreat. You agree to hold the appropriate insurance for your travel and attendance at this Retreat.

7 Limitation of Liability

To the fullest extent permitted by law, we shall not be held liable for any loss, damage, injury, delay, or expense incurred by you as a result of participating in the retreat, whether arising from negligence, accident, or any other cause. This includes, but is not limited to personal injury, emotional distress, property loss, or force majeure events.

8 Medical Disclaimer

By participating in the retreat, you confirm that you are in good physical and mental health and capable of taking part in retreat activities. You agree to disclose any relevant medical conditions in advance. We do not provide medical advice or services, and participation is at your own discretion and risk.

Force Majeure

Our performance under these terms and conditions is subject to acts of god, war, government regulations, disaster, civil disorder, strike or other industrial dispute and any other circumstances which are beyond our reasonable control and which we deem (in our sole discretion) render the performance of our obligations uneconomic, impractical, impossible or illegal (‘Force Majeure Circumstance’). At any time during or after a Force Majeure Circumstance we may (in our sole discretion) elect to terminate this agreement by notice to you and refund any amounts paid by you, less our reasonable costs and expenses incurred in respect of your booking which we cannot reasonably recover.

10 Baton House – Safety and Hazards

Accommodation is situated on a working farm and there are hazards both natural and man-made. You accept that you enter the property at your own risk.

Participation in activities such as, outdoor baths and hot tub, climbing trees, walking or biking on the property and any other activity on the property is the responsibility of the Guest and is done so at their own risk.

The Baton Valley Trust accepts no liability for accident, loss of property or personal injury whilst on your stay.

11  Privacy

We value your privacy. During the retreat, photos and videos may be taken. We will always ask for your permission before sharing any identifiable images of you on social media, in marketing materials, or for publicity purposes.

12 Governing Law

These terms and conditions shall be governed by the laws of New Zealand and the parties submit to the jurisdiction of the courts in New Zealand.
